This document describes the ownership rights relating to the Plennie platform and the content posted by users (Providers and Customers).

1. Ownership rights of DELNOYE

All intellectual property rights relating to the Plennie platform, the software, the database structures, the interface (look-and-feel), the source code, the algorithms, the domain name and the trade name Plennie belong solely to DELNOYE, or are licensed from third parties.

Users (both Customers and Providers) are not permitted to:

  • Copy, reproduce or decompile parts of the platform.
  • Use the name "Plennie" or "DELNOYE" for their own commercial purposes without written permission.
  • Scrape data or use automated systems to extract information from the platform for reuse in other services.

2. Content of the Provider (Vendor)

The Provider in principle retains the intellectual property of the content they post, such as company logos, service descriptions and images (hereinafter: Vendor Content).

Licence grant: by posting content on the platform, the Provider grants DELNOYE a free, worldwide, non-exclusive licence to use, publish and reproduce this Vendor Content for the operation of the platform and for promotional purposes (for example in advertisements on social media or in newsletters).

Warranty: the Provider warrants that they are the rightful owner of the posted content (in particular photos) or holds the appropriate licences. The Provider indemnifies DELNOYE against all third-party claims for infringement of copyright or other IP rights.

Removal: after termination of the account, DELNOYE will remove the Vendor Content within a reasonable period, unless this content is needed to settle ongoing bookings or for tax evidence.

3. Content of the Customer (reviews and feedback)

Customers can leave ratings and reviews via the platform.

Transfer of usage rights: as soon as a Customer posts a review, DELNOYE obtains an unlimited and perpetual right to use this review for the platform and for marketing purposes.

Attribution: DELNOYE may state the Customer's (first) name with the review as provided by the Customer.

Moderation: DELNOYE reserves the right to remove Customer content if it is contrary to public decency, infringes third-party copyrights, or is defamatory in nature.

4. Use of the Service by Customers

Customers are not permitted to distribute or sell the information they obtain via the platform (such as specific working methods or course material of a Provider), unless this is explicitly part of the purchased service.

5. Notice of infringement (Notice and Take Down)

DELNOYE respects the IP rights of others. If a User believes that their rights are being infringed on the platform (for example a photo used by a Vendor without permission):

  • The User must report this via legal@delnoye.nl.
  • DELNOYE will investigate the report and, in the event of a justified complaint, remove or make inaccessible the relevant content within 48 hours.

6. Feedback on the Platform

If a User provides suggestions or feedback to DELNOYE about improving the Plennie platform, DELNOYE is free to implement these ideas without any compensation being owed to the User. The IP rights to such changes belong entirely to DELNOYE.

7. Enforcement

In the event of infringement of DELNOYE's intellectual property rights, DELNOYE reserves the right to:

  • Deny access to the platform immediately.
  • Impose a fine of € 500 per day that the infringement continues, without prejudice to the right to recover the actual damage suffered.
